As we reported to you over the weekend, we filed a federal lawsuit against New Mexico Governor Michelle Lujan Grisham, for her unconstitutional executive order banning the carrying of firearms in the name of a “public health emergency”. Today we are happy to report that New Mexico Attorney General Raúl Torrez, who is normally tasked with defending the Governor in court, sent a letter to Governor Grisham stating that he would not defend her against our lawsuit, as to do so would be a violation of the oath he took to uphold and defend the U.S. Constitution. Torrez, a Democrat who served in the Obama Department of Justice, elaborated: “Simply put, I do not believe that the Emergency Order will have any meaningful impact on public safety but, more importantly, I do not believe it passes constitutional muster.” Read more here. On Monday, Bernalillo County Sheriff John Allen announced that he would not be enforcing the order, because he also recognized it as unconstitutional.
Thank you, AG Torrez and Sheriff Allen, for honoring your oaths of office. Unfortunately, Governor Grisham does not appear to be backing down, so our battle in court continues.
