Earlier this year, the State of Connecticut issued an ultimatum to Milford Christian Academy and Little Eagles Preschool: force your students to get caught up on their vaccinations, or we’ll shut you down – regardless of their parents’ religious objections to vaccines. That’s when we stepped in and said not so fast. We filed a federal lawsuit against the State and were successful in keeping the doors to the school open. We also scored a major victory when the State admitted in a court filing that it lacked authority to enforce vaccine mandates in private schools. Now we face a critical hearing in that lawsuit this coming Monday, October 23, 2023 at 2:30 p.m. ET at the federal courthouse at 141 Church Street in New Haven, CT, when a federal judge will hear arguments to decide whether to grant or deny the State’s motion to dismiss the lawsuit. This is a seminal case in the history of Connecticut and the nation, as it pits the state directly against a church in a school vaccination case – the first lawsuit to ever do so in this context. It is so important, in fact, that we have learned tonight that even the Yale University and Quinnipiac University law schools are planning to send whole classes of law students to observe this hearing on Monday.
