
We recently reported that a Maine federal judge denied our requests for emergency relief in our Maine school religious exemption lawsuit. We are wasting no time in appealing to the First Circuit, but we have requested an injunction pending the appeal from the district court. This would allow the plaintiff’s son to attend school while the appeal is being heard by the First Circuit.
Here is an excerpt from our motion filed on September 9, 2026:
“[Maine’s school vaccination law] conditions [the child’s] public education on the performance of an act his father sincerely believes to be sin, a finding this Court made on an uncontroverted record. Storybooks can be countered at home. An injection cannot be undone. If exposure [to harmful curriculum] “substantially interferes with the religious development” of a child, compelled commission of the forbidden act does so a fortiori” [all the more].

We are working to move these proceedings along as quickly as possible, not only so this child can begin his school year, but so that all Maine children whose families have religious objections to vaccines can return to school. If we are denied at the First Circuit, we will immediately appeal to the U.S. Supreme Court, to seek a ruling that would allow all children in the nation to return to school with a religious exemption.
Stay tuned. Things are moving fast. Within a matter of weeks, we could be at the Supreme Court on the precipice of a monumental victory for the health freedom of every parent and child in the United States.
The importance of this moment cannot be overstated.
This would mean that ALL children with religious exemptions in California, New York, Connecticut, Maine, and West Virginia could finally go to school THIS YEAR.
