Justice Elena Kagan has ordered the Ventura Unified School District and State of California officials to provide a response to our emergency petition no later than October 1, 2025, in our lawsuit to restore the religious exemption to school vaccinations for California families.

We filed this lawsuit after a high school honors student was expelled after his parents asserted a religious objection to the state’s mandatory school vaccinations. The District Attorney then initiated truancy proceedings against the parents, although thankfully those were dropped after we challenged them in court. But now we are asking the U.S. Supreme Court to review our petition on an emergency basis, so that we can return this child – and all similarly situated children in California – to the classroom. With Justice Kagan’s order, we have moved one step closer to that victory.

But this is not over, and this is not just about California. A victory in this case could restore religious liberty from mandatory vaccinations for every student in the country, including those in several other states that currently do not have religious exemptions, like New York, Connecticut, Maine, and (for all practical purposes) West Virginia. And with the recent formation of the regional health alliances in the Northeast and on the West Coast, it is more important now than ever before that we fight back for the rights of families to refuse vaccinations and other forced medical interventions. Because if the elected officials in these states have their way, no parent will ever be able to refuse again.
