DECEMBER 10, 2024 (Washington, D.C.) – On Friday, December 6, 2024, the D.C. Circuit Court of Appeals upheld the law (known as the Protecting Americans From Foreign Adversary Controlled Applications Act, or PAFFACAA) demanding that TikTok be sold or banned by January 19, 2025. As you may know, we filed a lawsuit with co-plaintiffs Robert F. Kennedy, Jr. and Kristen Meghan Kelly challenging this law as an unconstitutional violation of the First Amendment’s free speech clause. Whether you love or hate TikTok, this ban is absolutely dangerous. Banning speech in the name of “national security” is a trap the American people have fallen into too many times before, and we cannot let it happen again. The government should not be able to force the sale of a social media platform or ban its existence simply because it wishes to suppress the information being shared on it.
